Personal information management policy and terms of use

Welcome to the FABRILIA website, operated by GESTION BARRETTE INC (the "SITE"). We are pleased that you are taking the time to visit and familiarize yourself with all the features of the SITE. We would first like to inform you that any person, parent or guardian ("User" or "you") who wishes to use the SITE is required to accept these TERMS OF USE as formulated by FABRILIA ("FABRILIA", "GESTION BARRETTE", "We" or "Us").

Please read them carefully.

By accessing and using the SITE, you agree to all of the Terms of Use and all related policies and guidelines set forth below (the "TERMS"). These are intended to facilitate your interaction with the SITE and with us.

Please note that we reserve the right to modify the CONDITIONS at any time, at our sole discretion. Any such modifications shall be effective immediately upon posting of a new or revised version of the TERMS and CONDITIONS on the SITE. Use of the SITE is governed by the version of the CONDITIONS or any policy or guideline posted or referred to on the SITE. If you continue to use the SITE after changes are posted, you will be deemed to have accepted those changes. If you do not accept the changes, you should immediately stop accessing and using the SITE.

1-Ownership of the SITE, its elements, copyrights, trademarks and domain names

All materials used or displayed on the SITE, including trademarks, domain names, text, graphics, logos, icons, images, illustrations, designs, audio clips, video clips, HTML language, software code and underlying meta tags, as well as the collection, arrangement and assembly of such materials (the "SITE Content"), are the exclusive property of GESTION BARRETTE or third parties and are protected by copyright, trademark and other applicable laws.

2-Use of the SITE

You are authorized to display on your computer and any mobile device, download and use the SITE Content, and to print a single copy, solely for your personal non-commercial use, provided that you do not modify, sell, reproduce, distribute, retransmit, publish, display or repost the SITE Content, nor make derivative works or otherwise use them for commercial purposes, without the prior written consent of GESTION BARRETTE. Nothing contained herein shall be construed as granting you any ownership rights in the SITE or the SITE Content. Should you wish to use the SITE Content for purposes other than your own personal use, or to modify the SITE Content, please contact us by e-mail at support@fabrilia.ca.

You may not frame or utilize framing techniques to enclose any SITE Content or other GESTION BARRETTE proprietary information, nor may you use any meta tags or any other "hidden text" utilizing our name, trademarks, third-party marks or SITE Content without our express written consent.

You agree to use the SITE only for lawful purposes. You acknowledge that you may not access the SITE from any jurisdiction where its use or content is prohibited by law. In this regard, you agree that GESTION BARRETTE cannot be responsible for compliance with foreign local laws that may be applicable to you.

3-Privacy Policy

GESTION BARRETTE is concerned about the protection of your personal information. Accordingly, we adhere to strict rules regarding the collection and retention of personal information.

In the course of your interaction and use of the SITE, GESTION BARRETTE may at times ask you to provide various personal information ("Information"), such as your name, mailing address, telephone number, e-mail address or date of birth, demographic data and personal references. GESTION BARRETTE may also obtain Information by asking you to voluntarily answer certain questions on the SITE or by collecting Information when you access the SITE, when you register for our mailing list, an event, an activity, when you make a request to purchase or obtain a product, or when you participate in a survey or contest.

Password - Any password used for the SITE is for your use only and you are responsible for its security. You agree that the username and password you use to access certain sections of the SITE are confidential and you are responsible for maintaining their confidentiality at all times. GESTION BARRETTE may, however, monitor your password and request that it be changed.

GESTION BARRETTE does not sell or rent the personal information you provide to us to third parties. However, GESTION BARRETTE may disclose it to its employees, contractors, associates and legal representatives authorized for the purposes described above ("Partners"), who are subject to the same obligations. However, GESTION BARRETTE will not share your Information with third parties without your consent unless required to do so by law or unless GESTION BARRETTE has advised you at the time of collection that it may do so.

GESTION BARRETTE maintains the confidentiality of the Information it collects and has adopted reasonable physical, electronic and administrative means to protect it. Please be advised that despite these measures, it is possible, due to the nature of the Internet, that third parties may have access to your Information when you transmit information on-line or when you access the SITE.

4-Modifications to the SITE

GESTION BARRETTE may modify or discontinue, at any time, temporarily or permanently, any part of the SITE, and may limit or prohibit access to the SITE, with or without notice.

5-Hyperlinks

The SITE contains hyperlinks to third-party websites. The presence of such hyperlinks does not imply GESTION BARRETTE's endorsement or approval of the other party's activities, or vice versa, nor does it imply any relationship between GESTION BARRETTE and the other party. We are not responsible for the availability of such other websites or for their content. When you access another web SITE, you should read the TERMS AND CONDITIONS that govern it before using it or disclosing any personal information.

GESTION BARRETTE encourages hyperlinks to the SITE. However, GESTION BARRETTE does not wish to be linked to any third party site (i) that contains any content constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, provincial, national or international law or regulation, that is likely to damage or harm GESTION BARRETTE's business, credibility or integrity, or that contains, posts or transmits any material or information that exceeds the moral and/or legal standards of Canadian society; or ii) which contains, displays or transmits any information, software or other material which violates or infringes upon the rights of others, including material which is an invasion of privacy or publicity rights, or which is protected by copyright, trademark or other proprietary right. GESTION BARRETTE reserves the right to prohibit or refuse to accept any hyperlink to the SITE at its sole discretion, at any time. You agree to remove any hyperlink you may have to the SITE upon GESTION BARRETTE's request. 

6-Liability

You acknowledge and agree that the SITE and the SITE Content are provided "as is" and "as available", without warranties of any kind, either express or implied. The SITE may include inaccuracies or typographical errors. If you download or otherwise obtain SITE Content or third-party content through the SITE, you do so at your own risk and are solely responsible for any damage to your computer or loss of data that results.

GESTION BARRETTE, its affiliates, subsidiaries and their respective directors, officers, shareholders, employees, representatives and advisors shall not be liable to you for any direct, indirect, special, consequential or exemplary damages, claims, losses, expenses or liabilities of any kind whatsoever arising out of any fault, omission or negligence, whether in contract, statute or otherwise, resulting from, but not limited to: i) your access to, use of, or inability to access or use the SITE, SITE Content, third-party content or a hyperlinked SITE from the SITE; ii) any failure of the SITE, SITE Content or Third-Party Content to operate properly due to error, omission, interruption, defect, delay in operation or transmission, computer virus or line failure; or iii) any other matter relating to the SITE, SITE Content or Third-Party Content.

7-Transactions

In the event that you order merchandise and/or services from the SITE, you must provide complete and accurate personal information. GESTION BARRETTE, at its sole discretion, reserves the right at any time after receipt of your order to accept or decline your order. You acknowledge that the price of goods and services may change without notice and that goods and services are subject to availability. 

All transactions carried out via the SITE are processed by an external service provider. As such, all information collected, including financial information, is not provided to or accessible by GESTION BARRETTE. You must contact the supplier you have used in the event of an incident involving your personal information.

In the event that, through the SITE, you purchase online products and/or services offered by third parties ("Third Party Merchandise"), GESTION BARRETTE is not responsible for the legality, quality, accuracy, reliability or any other aspect of the Third Party Merchandise. If you make a purchase from a third-party site hosted by or linked to the SITE, information obtained during your visit to the third-party site and information you provide, such as your credit card number and contact information, is collected by the third-party site and not by GESTION BARRETTE.

You hereby release GESTION BARRETTE, its affiliates and their respective directors, employees, agents, licensors or their respective successors and assigns from any and all damages you may suffer, and agree not to assert against them any claim arising from your purchase or use of Third Party Merchandise offered on the SITE or on Third Party Sites through the SITE. 

9-Indemnification

You agree to indemnify, defend and hold GESTION BARRETTE, its affiliates and their respective directors, employees, agents, licensors or their respective successors and assigns harmless from and against any and all claims, demands, liabilities, costs or expenses whatsoever, including without limitation legal fees and disbursements, resulting directly or indirectly from: (i) your breach of the TERMS; (ii) your browsing, use or inability to browse or use the SITE and/or its features or any SITE to which the SITE is or may be linked from time to time; (iii) your use of, or reliance on, publications, communications, distributions or downloads of any kind through the SITE and/or its features; and/or (iv) your violation of any applicable law or regulation. You agree to cooperate with us in contesting any claim.

10-Applicable law

Your use of the SITE, its features and its CONDITIONS is governed by the laws of the Province of Quebec and the laws of Canada, without regard to principles of conflict of laws. You hereby agree that any dispute arising out of or relating to your use of the SITE, its features or its CONDITIONS shall be submitted to the jurisdiction of the courts of the district of Montreal, province of Quebec.
